1. Acceptance of Terms

By using Moon Phase Poster ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

The App is a credit-based tool available within the Canva platform that allows users to:

• See the moon's phase and orientation for any date, time and place
• Customize the poster's color scheme, brightness and frame
• Add a caption with details such as the place, date and phase, plus their own text
• Add the moon image, caption and frame to their Canva design as editable elements

3. Credits and Payment

Adding a poster to a design uses credits. The number of credits each poster uses is shown in the App before you add it.

• New users may receive free credits. The number of free credits is set at our discretion and may change.
• Additional credits are sold in packs as one-time purchases processed through Gumroad. There are no subscriptions.
• Pack sizes and prices are shown at the time of purchase and may change from time to time.
• Credits are tied to the Canva account that bought them. They are specific to Moon Phase Poster and cannot be transferred, exchanged for cash, or used in other apps.
• If a poster cannot be added to your design, the credit it used is returned automatically.
• Credits are not Canva credits, and purchases are not part of any Canva subscription.

4. Use of the App

4.1 Permitted Use

You may use the App to:

• Create moon phase posters for your own Canva designs, including designs you print or sell
• Modify designs you have permission to edit

4.2 Prohibited Use

You may NOT use the App to:

• Modify designs you do not have permission to edit
• Violate any applicable laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or access the App's source code
• Manipulate, abuse or attempt to bypass the credit system or the credits server
• Use the App in any way that could damage or impair the Canva platform

5. Design Modifications

You are responsible for:

• Reviewing the poster before finalizing or printing your design
• Ensuring the date, time and place you enter are correct

6. Astronomical Accuracy

The App calculates the moon's phase and orientation from the date, time and place you provide. While the App strives for accuracy:

• Posters are intended for decorative and commemorative purposes
• The moon image is a rendering based on lunar imagery, not a photograph taken at that moment
• The App is not intended for scientific, navigational or astrological use

7. No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App or the credits server will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of astronomical calculations

8. Limitation of Liability

The developer (Naveen Bhavnani) shall not be liable for any damages arising from your use of the App, including but not limited to:

• Unintended changes to your designs
• Loss of design work or data
• Business losses or lost profits
• Any indirect, incidental, special, or consequential damages

In any case, our total liability shall not exceed the amount you paid for credits in the twelve months before the claim.

9. Canva Platform Terms

Your use of this App is also governed by:

• Canva's Terms of Use
• Canva Developer Terms

In case of conflict between these Terms and Canva's terms, Canva's terms shall prevail.

10. Intellectual Property

The App and its original content, features, and functionality are owned by Naveen Bhavnani and are protected by international copyright, trademark, and other intellectual property laws.

The designs you create using the App remain your own property.

The moon is rendered from public-domain lunar imagery. Lunar surface: NASA's Scientific Visualization Studio / NASA/GSFC/Arizona State University. This credit does not imply endorsement of the App by NASA or any other agency.

11. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time
• Update features, credit costs or pack pricing
• Change these Terms of Service (changes will be posted on this page)

Continued use of the App after any such changes constitutes your acceptance of the new Terms.

12. Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, if:

• You violate these Terms
• You use the App for illegal purposes
• Required by law or Canva's policies

13. Indemnification

You agree to indemnify, defend, and hold harmless Naveen Bhavnani from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the App
• Designs you create using the App
• Your violation of these Terms
• Your violation of any third-party rights

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

17. Entire Agreement

These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and Naveen Bhavnani regarding the use of the App and supersede all prior agreements and understandings.
