Terms of Service

1. Acceptance of Terms

By using Color Splash ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

The App is a credit-based tool available within the Canva platform that allows users to:

• Select an image on their Canva design
• Optionally describe which subject to keep in color
• Apply a color splash effect that keeps the subject in color while converting the background to grayscale
• Preview and add the processed image to their design

3. Credits and Payment

The App uses a credit-based model. Each use of the color splash effect consumes one credit.

• Credits are available for purchase in packs of 10, 50, or 100
• All purchases are one-time transactions processed through Lemon Squeezy
• Credits do not expire but are non-transferable
• Pricing is displayed at the time of purchase and may be updated from time to time

4. Use of the App

4.1 Permitted Use

You may use the App to:

• Apply color splash effects to images in your own Canva designs
• Modify designs you have permission to edit
• Use the color splash functionality for legitimate design purposes

4.2 Prohibited Use

You may NOT use the App to:

• Process images you do not have the right to use or modify
• Violate any applicable laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or access the App's source code
• Use the App in any way that could damage or impair the Canva platform or backend services
• Attempt to overload or abuse the processing server

5. Image Processing

You are responsible for:

• Ensuring you have the right to process the images you submit
• Reviewing the processed result before finalizing your design
• Making backups of important designs before applying effects

6. No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of subject detection or background separation

We do not guarantee that:

• The subject will be perfectly detected in all images
• The color splash effect will produce satisfactory results in all cases
• The processing server will be available at all times
• The App will be compatible with all image types

7. Limitation of Liability

The developer (Naveen Bhavnani) shall not be liable for any damages arising from your use of the App, including but not limited to:

• Unintended changes to your designs
• Loss of design work or data
• Unsatisfactory processing results
• Business losses or lost profits
• Any indirect, incidental, special, or consequential damages

8. Canva Platform Terms

Your use of this App is also governed by:

• Canva's Terms of Use
• Canva Developer Terms

In case of conflict between these Terms and Canva's terms, Canva's terms shall prevail.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Naveen Bhavnani and are protected by international copyright, trademark, and other intellectual property laws.

The designs and images you process using the App remain your own property.

10. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Update features or functionality
• Change these Terms of Service (changes will be posted on this page)

Continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, if:

• You violate these Terms
• You use the App for illegal purposes
• Required by law or Canva's policies

12. Indemnification

You agree to indemnify, defend, and hold harmless Naveen Bhavnani from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the App
• Images you process using the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

16. Entire Agreement

These Terms constitute the entire agreement between you and Naveen Bhavnani regarding the use of the App and supersede all prior agreements and understandings.
